Street Excavation Ordinance Advertisement
NOTICE IS HEREBY GIVEN BY the Council of the Borough of New Cumberland, Cumberland County, Pennsylvania, of the intention to consider adoption of Ordinance No. 726 at a duly convened meeting of Borough Council to be held on Wednesday, June 11, 2025, at 7:00 p.m. at the Borough Administration Office, 1120 Market Street, New Cumberland, Cumberland County, Pennsylvania 17070. Ordinance No. 726 is entitled: “An Ordinance regulating the digging of trenches, openings and excavations in the streets of the Borough of New Cumberland, Cumberland County, Pennsylvania, require refilling of same and resurfacing the streets as required, establishing permit and fee procedures, prescribing penalties for violations thereof, repealing all inconsistent ordinances, and establishing an effective date.”
Ordinance No. 726, if enacted, makes it unlawful for any person to open or to make any excavation of any kind in any of the streets in the Borough of New Cumberland without first securing a permit. Establishes fees in an amount as fixed by Resolution. Provides stipulations for refilling and restoration of the excavation. Includes a degradation fee for excavations in pavements less than five years since resurfacing. And provides penalties for violations of the Ordinance.
